Welcome to Mindora Wellness LLC (“Mindora,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website and services. By accessing our website or engaging our counselling services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

About Our Services

Mindora Counselling provides professional counselling and therapeutic services. Our services are designed to support individuals navigating personal challenges through evidence-based therapeutic approaches. All services are provided by qualified and licensed mental health professionals.

Professional Relationship

The relationship between Mindora counsellors and clients is strictly professional. Our services establish a therapeutic relationship, not a social, personal, or business relationship beyond the scope of counselling.

Nature of Therapeutic Work

The purpose of the Services is to support the Client’s well‑being, growth, and improvement of their circumstances.

The Client understands that sessions may involve exploring underlying issues, which may temporarily intensify symptoms before improvement occurs. Outcomes depend on multiple factors, including the Client’s participation and external circumstances, and may not align with the Client’s expectations.

Client Attestation

The Client declares that they do not have any mental or psychological disorder, nor a history of such conditions, and are not currently undergoing psychiatric or psychological treatment or medication. The Client confirms that all disclosures made to Mindora and/or the Practitioner are full, accurate, and truthful.

If the Client is found to have breached this declaration, Mindora and/or the Practitioner may immediately terminate all Services. In such cases, Mindora and the Practitioner shall bear no liability for any consequences arising from the Client’s breach, and Mindora may, at its sole discretion, forfeit all Fees paid.

Communication Protocol

The Client acknowledges that Mindora acts as the communication channel between the Client and the Practitioner. The Client agrees not to communicate with the Practitioner directly or indirectly outside of Mindora’s channels.

The Practitioner alone is responsible for the Services rendered to the Client.

Qualifications

All counsellors at Mindora hold appropriate qualifications, licenses, and professional memberships as required by applicable regulations in Hong Kong.

Client Responsibilities

You agree to provide accurate, current, and complete information during the intake process and throughout your engagement with our services.

Client Consent & Acknowledgment

By attending sessions, the Client confirms that:

  • They consent willingly and without undue influence to all practices performed by the Practitioner.
  • They have received a copy of these Terms & Conditions.
  • They have had the opportunity to ask questions before signing.
  • They agree to all terms stated herein.

Confidentiality

All information shared between the Client and the Practitioner is confidential. Disclosure is permitted only:

  • To Mindora
  • To a supervisor of the Practitioner with the Client’s consent
  • As required by law, regulation, or court order
  • Where the Practitioner is ethically or legally obligated to disclose, including: Risk of harm to self or others Suspected or potential child abuse or neglect Reports of sexual abuse by a regulated health professional Abusive or threatening behaviour by the Client

The Client consents to the sharing of their Client Information Form and practitioner notes with another Practitioner within Mindora should they choose to work with a different Practitioner.

Payment & Refund Policy

All payments made for Services are non-refundable, except in the following circumstances:

  • (a) A medical emergency affecting the Client, supported by valid documentation (e.g., medical reports, doctor’s notes).
  • (b) Cancellation of the Service by Mindora.

Packages may be shared among family members residing in the same household.

All packages carry an expiration date.

Session Confirmation

A session is considered confirmed only upon receipt of a written confirmation email from Mindora.

Verbal agreements are not valid unless supported by written confirmation.

Cancellation Policy

  • Cancellations must be made at least 1 working day before the scheduled session.
  • Cancellations made within 1 working day (24 hours) will incur a 50% charge of the session fee.
  • Cancellations made within 3 hours of the session or failure to attend will incur a 100% charge.
  • If a session is offered and confirmed within 24 hours, and the Client cancels thereafter, a 50% charge applies to honour the Practitioner’s time.

Release & Indemnity

The Client releases and forever discharges Mindora, its Practitioners, employees, directors, consultants, property owners, and any individuals on its premises from all liability arising from or connected to the Services or the use of Mindora’s premises.

The Client agrees to fully indemnify Mindora and the Practitioner for all losses, damages, and legal costs arising from claims related to the Services.

Termination of Services

Mindora may terminate Services immediately under the following circumstances:

  • Client breaches any term of this Agreement
  • Practitioner is unable to provide Services
  • Mindora’s premises become unavailable
  • Client fails to pay Fees when due

The Client may terminate Services at any time; however, all purchased sessions and packages are non-refundable. Transfers to a family member may be permitted with written approval from Mindora.

Personal Data Collection & Use

Mindora collects personal data (“Personal Data”) for the following purposes:

  • Internal administration and record maintenance
  • Communication with the Client
  • Sharing with Practitioners, partners, or contractors on a need‑to‑know basis
  • Marketing and promotional activities
  • Research and analysis
  • Compliance with laws, regulations, or court orders in HKSAR

Clients may request access to or correction of their Personal Data by emailing Mindora at hello@mindoracounselling.com.

Weather & Safety Arrangements

In the event of a Black Rainstorm Signal or Typhoon Signal No. 8, Services will be postponed or cancelled in accordance with the laws and regulations of the Hong Kong Special Administrative Region (“HKSAR”).

Third‑Party Rights

These Terms are personal to the parties. The Contracts (Rights of Third Parties) Ordinance (Cap. 623) does not apply. No third party has any right to enforce or benefit from these Terms.

Governing Law

This Agreement is governed by the laws of the Hong Kong Special Administrative Region.

Both parties submit to the exclusive jurisdiction of the courts of HKSAR.
